Things to consider about Mediation
There are numerous things to consider when starting Mediation, which can leave you feeling overwhelmed and unsure what to do. To put your mind at ease, we have composed a list of things you may wish to think through before, and during your Mediation process.
This list isn’t exhaustive, and you should remember that every Mediation process is unique to the parties undertaking it.
Before choosing a Mediation Service
You want to ensure that you are working with a Mediation service that is suitable for you and your needs, it is important to consider:
- Is your Mediator Accredited with the Family Mediation Council (FMC)?
- Do they offer publically funded/Legal Aid Mediation? If so, do you or the other party qualify for this? To find out, it is advisable to visit the UK website. If you are not eligible and the other party is, you will get your Assessment and 1st session free. If the service you have approached don’t offer this then look for one that does.
- Does the Mediation service offer the Family Mediation Council Voucher Scheme? This, where available, can provide £500 towards each case cost for mediation time. Since its introduction in April 2021, the voucher scheme has provided a huge benefit to families needing to discuss all, part, or some of their child care arrangements.
Before starting your Mediation Sessions
Before you attend your sessions, it is important to be prepared, we advise that you:
- Read all information sent to you prior to your first assessment: If you do not, you may delay the start of your process or misunderstand an important aspect.
- Attend an assessment meeting (MIAM): This assessment meeting will allow you to find out whether ongoing mediation will be suitable for your circumstances, and will also discuss the willingness of both parties to proceed.
What else should I consider?
Mediation is a transparent and impartial process, if there are any points that you feel unsure, or require clarification, it is important to ask.
Even if your Assessment/MIAM, does not proceed to mediation meetings, you will have been provided with new information to assist you going forward.
