What is Mediation?
Mediation is a process that is used by people and organisations, with the purpose of helping resolve disputes. Most family disputes, can be Mediated when parties are willing to participate in the Mediation process and a Mediator determines that the process is suitable.
Mediation has the ability to resolve a wide variety of issues involving: family arrangements, workplace and employment disputes, civil and commercial matters for businesses and much more. It is a private and confidential process where various parties are able to communicate in a trustworthy environment, with the impartial guidance of a trained mediator.
During the Mediation process, no one is forced to do anything they do not want to do, thus allowing you to stay in control of a situation. A trained Mediator, will impartially assist families to explore options, which could resolve family difficulties and disputes.
How does it work?
The great thing about the process of Family Mediation, is that it can be tailored to suit your needs, availability and preference. There are numerous ways in which a Mediation session can take place, such as:
- Face-to-face meetings: In face-to-face meetings, both parties are present in the same Mediation room with a trained Mediator. The role of the Mediator in this instance is to impartially manage your process, and help you come to an agreement that suits everyone.
- Shuttle Meetings: We understand that sometimes some parties are willing to take part in mediation, however, they would prefer to go through this process separately. During Shuttle Meetings individual parties will have their own separate and private room. In this case the Mediator will move between each room and update each party on the views and proposals made by the other.
- Remote Meetings: There are occasions whereby it is difficult to be in the same place at the same time, and due to the Coronavirus outbreak, carrying out remote Mediation sessions has allowed for us to continue assisting those who require them. In the appropriate circumstances remote mediation sessions may be suitable and offered to parties via the use of Zoom, Skype or WhatsApp video calling. These can be either ‘face to face’ or shuttle meetings.
What are the benefits of Family Mediation?
Family Mediation is a beneficial way of exploring different options in order to work out which will be the best option for you, the parents, and your grandchildren. It can offer a positive environment, if it is suitable and all participants are willing to consider discussing grandparents’ roles and time with children. This can involve grandparents being part of the Mediation process directly, or alternatively, providing support, to parents who are mediating.
The process requires participants to commit to the process, encouraging communication, between family members, impartially assisting them to come to their own arrangements, therefore preventing them from damaging and costly Court Proceedings.
Mediation sessions take place in a confidential and non-judgemental environment to ensure families feel safe to discuss their problems and anxieties freely, in order to make arrangements for the future. The sessions allow for participants to come to an amicable arrangements regarding family arrangements.
