What is a MIAM?

MIAM is short for Mediation Information and Assessment Meeting and represents the first meeting you would have with your mediator. This is to discuss arrangements regarding children and finances and to understand whether on-going mediation is the right option for you and your family.

During your Mediation Information and Assessment Meeting, your mediator will advise on information and services that can support you and your family whilst you resolve any disputes.

Do you need to attend mediation before court?

Yes. Attending a MIAM is in fact a requirement should you wish to take your case to court. Both parties involved are expected to attend a MIAM however, you can attend separately, or in joint meetings.

The court will want to know that you have attended mediation before attending court proceedings, if you have not, then your case may be put on hold until each party has attended mediation.

What’s involved in the Mediation meeting?

During a MIAM our mediators will help both parties discuss the issues they are facing, gaining a better understanding as to whether further mediation is required.

Attending mediation is an opportunity for you to think about what is the best solution for you and your children. Our mediators are here to assist you through the process and help both parties come to an amicable agreement.

Although we cannot make decisions for you, we can help guide you, and answer any questions you have during the process.

What is an FM1 form?

The FM1 form is a technical part of the divorce process and should be presented during a MIAM so that your mediator can provide evidence in section 1 of the FM1 form that you have completed a Mediation Information and Assessment Meeting.

If a MIAM has not been completed, mediators will fill in part 2 of the FM1 form which may include a reason for why a MIAM was not attended. This could include reasons such as: the mediator has concluded that this particular case is unsuitable for mediation, or that one of the other party wishes not to attend an assessment meeting, and therefore the mediation process cannot continue effectively.
